This videography agreement is made and entered into by and between Just Shoot Me Videography (“Company”) and ______________________________________________ (“Client”).

PAYMENT:
A non-refundable retainer of 20% is required to hold the event date; this will be applied to the total cost. The remaining balance is due upon delivery of a completed DVD.
Cash or check only
For any returned checks there is a NSF fee of $35 and all future orders must be paid with cash or a cashier’s check.
Client has three (3) days to view DVD for approval
DVD only NO VHS Tapes
Additional DVD’s are $25 per disc
Any event that the client attends for the purpose of eating a meal and that JSM is required to shoot, the client will also provide a meal for each camera person(s) required to attend.

CANCELLATION:
If there is a postponement or cancellation of the event the retainer paid is non-refundable.
If the cancellation takes place within thirty days of the event the balance is due in full.

LIABILITY:
This is a binding contract and may only be altered in writing and if approved by JSM. JSM shall not be liable for compliance with this contract if an Act of God, Act of War, failure of transportation or equipment, or failure by circumstances of any similar nature beyond the reasonable control to JSM. In such event, JSM’s liability is limited to the refund of the retainer.
JSM is not responsible for lost video opportunities due to camera failure, vendors, or actions of any participant.
JSM is not responsible for poor sound quality on the DVD due to loud background noises at the client’s choice of location(s).
JSM is not responsible for poor video quality on the DVD due to insufficient lighting conditions at the client’s chosen location.
JSM is not responsible for missed taping due to restrictions concerning the placement of cameras at the event location.
JSM is not responsible for lack of video coverage due to weather conditions or schedule complications due to the lateness of individuals, rules/restrictions of the ceremony location or the rendering of decorations of these locations.
JSM will not be responsible for any damage or soiling of clothing from video sessions on location.
The client is responsible for collecting items due to them by JSM. If items are not collected within one year of the event date the client forfeits any and all items due by JSM.
The Client understands that signature of this contract gives consent to JSM to use Client's voice and image in the DVD. Client is responsible for ensuring that each person attending the event understands and agrees that attendence at the event constitues permission by each such attendee for JSM to use his/her voice and image in the DVD. Client will indemnify and hold JSM harmless from any loss or damage based on the claim of any attendee not to have given such permission.
The Client also represents to JSM that Client has secured all necessary permission(s) for use of copyrighted material and will indemity and hold JSM harmless from any failure to do so.
JSM is not responsible for consequential damages; even if it's our problem, we cannot replace your moment. Our responsibility is limited to refunding your payments to us.

EXCLUSIVITY:
JSM’s staff are those only permitted to videograph poses arranged and created by the videographer; in the event of a wedding, the Bride and Groom are responsible for enforcing this rule at the request of the videographer.
If this rule is not enforced, this contract becomes void and the videographer has the right to leave the function immediately.
Other cameras flashes may ruin the quality of JSM’s taping; JSM is not responsible for images lost due to other camera flashes.
Family and friends may photograph candid situations provided they do not interfere with the videographer’s execution of duties.
JSM’s staff will defer to the contracted event official photographer and will not interfere with the execution of their duties. JSM requests that the photographer be notified the event will also be videographed and make arrangements to introduce JSM and the Photographer prior to the event.

DVD TAPES:
Tapes are the property of JSM
JSM reserves the right to use images and/or reproductions for display, publication or other purposes.
If you are interested in purchasing your DVD tapes, it is your responsibility to contact JSM to do so. Tapes may be purchased up to one year after the client has taken delivery of the final order and JSM will determine the price; otherwise the tapes will be destroyed after one year.

SCHEDULE OF EVENTS:
At the time of your consultation, a time line for videography of your event will be set. This is to insure enough time to capture creative images along with the required quantity of images for your specific package.
If videography does not begin at the scheduled time due to circumstances beyond the videographer’s control, the videographer cannot be held responsible and this may result in failure to produce the quality or quantity of images needed for your package.

ORDERS:
If an Engagement or Bridal montage is needed for the wedding, allow 20 business days.
A montage to be shown at or before a wedding is available for an additional $25.00. The extra fee includes time and materials. The montage may be used again the in the final product as a part of the final video.
Additional copies of the finished DVD (s) may be ordered up to seven (7) days after the delivery and acceptance of the final product. Due to storage limitations JSM cannot guarantee the DVD will be available after seven (7) days.

TRANSACTIONS:
All meetings and delivery of products will be conducted at our location unless prior arrangements have been made and approved by JSM.
Anyone wishing to have DVD’s shipped to them agrees to pay any and all applicable shipping, handling, and insurance charges.

COPYRIGHT:
It is ILLEGAL to copy or reproduce these DVD(s) elsewhere without JSM’s written permission. Violators of this Federal Law will be subject to its civil and criminal penalties, and will be prosecuted. _____________(Initial)

This contract, together with the bid, timelines, and specifications attached to it, constitue the entire agreement of the parties and no prior or contemporateous representations or agreements not incorporated herein shall be binding; any change must be in writing and signed by both JSM and Client. This contract is governed and construed by the laws of the State of Texas and any disputes are to be brought in Denton County, Texas.

IF ANY OF THESE TERMS ARE VIOLATED, THIS CONTRACT BECOMES NULL & VOID AND JSM IS UNDER NO FURTHER OBLIGATION TO PROVIDE ADDITIONAL SERVICES.
